The End is Near!
Per my email to Scott Barker at the City:
Per Appendix B of the DPB Minutes for Monday, June 1, 2009:
"B.1.2 It should be noted that if conditions 1.0 and 2.0 have not been complied with on or before December 1, 2009, this Development Application shall be deemed to be refused, unless the date for compliance is first extended by the Director of Planning."
Please let me know when and by whom the extension was granted, or if the Application Approval is deemed to be refused.
The response I got from Mr. Barker (which infuriates me to no end!) was:
This condition has consistently been interpreted and applied to be the date by which the applicant provides a written response to the conditions of approval. The intent is to allow the Director of Planning to refuse an application where no reasonable progress is being made to satisfy the conditions. In this case, the applicant team has been working towards satisfying the conditions for the last several months, and the Director of Planning has no intention of refusing this application on the basis that a permit was not issued by the stated date.
In other words, it matters not that the developer has not met any or all of the approval conditions.
